Family and Child Law

We can also prepare powers of attorney which avoid the need for the more time-consuming guardianship process. All powers of attorney are tailored to each client's specific needs and provide peace of mind that should a loved one lose capacity there will be no need for guardianship proceedings.

Mental Health Law 
We act for patients, carers and family members across all aspects of mental health and incapacity law. We have significant experience in contentious and non-contentious welfare and financial guardianships and intervention orders and highly specialised proceedings before the Mental Health Tribunal for Scotland. Andrew McLaughlin has also been appointed Curator ad Litem by the Tribunal demonstrating his commitment and experience in this area of law. Unlike many other solicitors we offer welfare guardianships on a Legal Aid basis where appropriate. In respect of mental health law, we advise patients and their families in relation to all aspects of statutory detention and treatment; including short term detention certificates, compulsory treatment orders, and compulsion orders with or without restriction orders monitored by the Scottish Ministers. Andrew has been at the forefront of this area of law for many years and has pursued many of the leading cases in this field. He also has experience of advising social work and clinical team members on behalf of a local authority providing Andrew with a unique insight into these legal issues.
