Repossession Proceedings and Eviction Orders

At McLaughlin & Co our solicitors are able to provide specialist legal advice for residential landlords in relation to evicting tenants. We currently offer a three-step pricing process so that you know exactly how much each stage of the eviction process will cost. 

Step One:

We offer a fixed fee of £200 plus VAT for the services of the eviction notice. This includes correctly serving s33 Notices, Notices to Quit and Form AT6 if required. Just one mistake in these forms can cause the whole proceedings to be rejected by the Tribunal so it’s vital that these forms are completed accurately and served correctly.

Step Two:

Raising of Tribunal proceedings up to and including Case Management Discussion where eviction may be granted for £550 plus VAT and outlays. We will raise the appropriate applications seeking an eviction order and a payment order for rent arrears if appropriate and represent you robustly throughout the process. We aim to protect your investment at all costs and secure recovery of your asset as soon as possible.   

Step Three:

Enforcing judgement - £150 plus VAT and outlays. We will instruct and liaise with sheriff officers regarding arranging the eviction and looking to make it as smooth as possible for you.
 

The First-tier Tribunal for Scotland (Housing and Property Chamber)

Civil cases relating to the private rented sector are no longer be dealt with as a Summary Cause Action raised within the Sheriff Court. These cases have been transferred to the First-tier Tribunal for Scotland (Housing and Property Chamber). Landlords are now able to apply to the Tribunal for eviction and repossession orders where they consider that they have ground(s) for eviction.
